The minimum wage rate and overtime provisions applicable to the retail and service industries, business support services, food and beverage, and health and medicine. The seventh-day overtime law does not apply when the employee is not allowed to work more than 40 hours in total during the workweek. The federal minimum wage also includes a long list of exceptions for jobs where employees may be paid less. The seventh-day overtime law, which is independent of the minimum wage law, requires that employers who allow covered employees to work seven days in any workweek pay the employee at a rate of one and a half times for the hours worked on the seventh day when employees work all seven days of the work week.
It encourages workers to obtain additional training and skills to help them overcome the increases required by the government. Residential workers (resident workers) receive a premium for hours worked for more than 44 hours in a payroll week. The predictable schedule of increases helps plan the budget, but creates ongoing compliance obligations. Employers must also keep detailed records for at least three years, including time worked, wage calculations and deductions. State law excludes from coverage any employment that is subject to the federal Fair Labor Standards Act, unless the state wage rate is higher than the federal rate.
The substantial gap also means that Florida employers cannot rely on compliance with the federal minimum wage as adequate protection. In restaurants and hotel restaurants, for the seventh consecutive day of work, a premium equal to half of the minimum rate is required. There is a higher minimum wage in the Portland metropolitan area and a lower minimum wage in non-urban counties. Employees receive 1 hour of minimum wage pay in addition to the wage due when the difference in hours exceeds 10 hours, there is a split shift, or both.
The State adopts the federal minimum wage rate as a reference if the federal rate is higher than the state rate.
